2. The present case has been taken up out of term on the basis of the Motion slip filed on behalf of the petitioner on the ground that the petitioner is a candidate of NEET UG examination, which is going to be held on 21.06.2026.

3. The petitioner seeks bail, who is in custody since 05.05.2026 in connection with Giriyak (Pawapuri) P.S. Case No. 217 of 2026, F.I.R. dated 03.05.2026 registered for the offence punishable under Sections 316(2), 318(4), 319(2), 336(3), 338, 339, 340(2), 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 66 and 66(D) of the Information Technology (Amendment) Act, 2000.

4. Allegation against the petitioner is that he hired a scholar to appear in the NEET examination in his place by the assistance of other co-accused.

5. Learned counsel appearing for the petitioner submits that it appears from the FIR that the petitioner was arrested in the present case. Allegation against the petitioner is that he hired a scholar to appear in the NEET examination in his place by the assistance of other co-accuse, whose names are mentioned in the FIR. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. In fact no incriminating article has been recovered from possession of the petitioner and petitioner has been made accused in the present case merely on the basis of suspicion.

Learned APP for the State on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that Rs. 1 lakh was transferred by the present petitioner in the A/c No. 40468374421 which was recorded in Para-23 of the case diary and account was registered in the name of Vijay Pal Singh and on the date of the examination i.e. on 03.05.2026 several whatsapp call has been made by the petitioner to coaccused Awadhesh Kumar, apart from the aforesaid, in para 24 of the case diary, it was recorded that the confessional statement

7. Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Giriyak (Pawapuri) P.S. Case No. 217 of 2026 pending in the court of learned Chief Judicial Magistrate (CJM), Nalanda at Bihar Shariff.
