2. The petitioner seeks bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.
3. As per prosecution case, the marriage of informant's daughter was solemnized with one Gautam Giri eight years ago and it is alleged that on 25.06.2023, her son-inlaw, namely Gautam Giri, informed that her daughter has died, while he was not present at his house. It is further alleged that when informant came to matrimonial house of her daughter, she came to know that this petitioner and co-accused Guddu Kumar
Patna High Court CR. MISC. No.40833 of 2025(2) dt.08-08-2025 2/3 Giri assaulted her daughter and committed her murder by wrapping Saree around her neck and thereafter, threw her deadbody in the field of maize.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner is not family member, rather she is next door neighbour and has got no concern with the deceased. As a matter of fact, the deceased herself committed suicide by hanging after altercation with her in-laws family members and since, there is previous enmity going on between the family members of both parties, the petitioner has been falsely implicated in this case. There is no allegation that this petitioner instigated or provoked the deceased to commit suicide. It is further submitted that similarly situated co-accused person, namely Guddu Kumar Giri, has already been granted bail by this Hon'ble Court vide order dated 11.04.2025 passed in Cr. Misc. No. 85842 of 2024. Petitioner has got no criminal antecedents and she is in custody since 19.12.2024. Moreover, charge-sheet has already been submitted.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the facts and circumstances of the case, claim based on parity, period of custody and clean antecedents of the petitioner, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Madhuban P.S. Case No. 301 of 2023.
