JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 147, 148, 149, 323, 332, 307, 353, 427, 120B and 337 of the Indian Penal Code and 3 of the Public Properties Act, 1984.

Allegation against the petitioner is that he along with others confined a woman with allegation of witch. When police personnel came to rescue her, petitioner and others pelted stone at them.

It has been submitted on behalf of the petitioners that they have no criminal antecedent. They have been made accused due to mistake of fact. General and omnibus allegations are made against them. Other co-accused have been granted bail vide Cr. Misc. no. 20492 of 2015.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let

No.39671 of 2015 (2) dt.30-09-2015 2 / 2 the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sadar, Motihari in connection with Sangrampur P.S. Case no. 57 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
