Petitioner seeks bail in Ganga Bridge P.S. Case No.58 of 2015 instituted for the offence under Section(s) 376(2) F of Indian Penal Code and Section 3⁄4 of POCSO Act. Counsel for the petitioner submits that he is not named in the First Information Report. It is further submitted that petitioner and brother of the informant are Gotiyas. There is land dispute between them. The victim girl has been examined under Section 164 Cr.P.C., wherein, she has not taken name of this petitioner. She has only stated that concerned person was living near the house of her Mama.

The victim girl has not taken the name of this petitioner either in the First Information Report or in her

Patna High Court Cr.Misc. No.42276 of 2018 (3) dt.24-09-2018 2/2 statement recorded under Section(s) 164 Cr.P.C. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1stcum- Special Judge, Vaishali, at Hajipur, in connection with Ganga Bridge P.S. Case No.58 of 2015, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- Rohit Kr.
