JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the complainant is languishing in jail since 19.07.2016 in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.

The basic accusation is of torture after about four years of the marriage and driving out the complainant from matrimonial house.

It is submitted by the learned counsel for the petitioner that though, the petitioner filed matrimonial Suit No.90 of 2013 prior to the lodging of the present complaint but the petitioner is still ready to keep the complainant as wife with full dignity and honour, statement to that effect has been made in para 12 of the

Patna High Court Cr.Misc. No.39399 of 2016 (2) dt.09-09-2016 2/2 petition which reads as follows:- "That still the petitioner is ready to keep the complainant with full dignity and regard as wife but it is the complainant who used to refuse to live with the petitioner."

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Saran at Chapra in connection with Complaint Case No. 1057 of 2013.
