Mr. Sri Arun Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-09-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Kanti P.S. Case No. 529 of 2017for the offence punishable under Section 392 of the Indian Penal Code. Informant has alleged that while on 08.12.2017 at about 7.15 PM he was returning from his motorcycle after business hour to his home, four unknown criminals on two motorcycles surrounded him and on strength of pistol snatched away the key of motorcycle and looted cash of Rs. 1.15 lacs and other documents from his possession.

It has been submitted on behalf of the petitioner that his name has surfaced in this case on the basis of

Patna High Court Cr.Misc. No.43316 of 2018(3) dt.24-09-2018 2/2 confessional statement made by one accused and except said confessional statement there is no incriminating materials against petitioner. Nothing has been recovered from his possession and similarly another accused person has been granted bail by this Hon'ble Court as contained in Annexure-2 of this application and other similarly placed co-accused persons has also been granted bail vide order dated 23.07.2018 passed in Cr. Misc. No. 35406 of 2018. Petitioner has no criminals antecedent and he is in custody since 13.02.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., West Muzaffarpur, in connection with Kanti P.S. Case No. 529 of 2017.
