The petitioner who is in custody since 13.12.2018 has filed the instant application for grant of bail in connection with Chausa P.S. Case No. 227 of 2018 registered for the offence punishable under sections 302, 120B and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the allegation in the FIR, on the date of occurrence while the informant and his deceased brother Md. Nasrul were returning to the house, on way the FIR named accused persons surrounded the brother of the informant. On the order of Dharmdeo Singh, co-accused Sunil Singh, Sanjay Singh and Pawan Singh fired as a result of which the informant's brother died on the spot. It is submitted by learned counsel for the petitioner that the case of the petitioner stands on a similar footing to that of co-accused Vijendra Mehta who has been enlarged on bail by order dated 14.05.2019 in Cr. Misc. No. 21249 of 2019 and Pankaj Singh who has been enlarged on bail by order dated 13.03.2019 in Cr. Misc. No. 7234 of 2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, UdaKishunganj, Madhepura in connection with Chausa P.S. Case No. 227 of 2018.
