Petitioner seeks bail in connection with UdaKishunganj P.S. Case No. 63 of 2019 registered for the offence punishable under sections 376 of the Indian Penal Code and Section 4 of the POCSO Act.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous land dispute. The age of the victim has been ascertained by the Doctor to be 15-17 years. From the medical report enclosed as Annexure-2, it would be evident that the Doctor did not find any sign of rape on the victim. Moreover, the matter has been compromised between the

Patna High Court CR. MISC. No.38983 of 2019(4) dt.04-09-2019 2/2 parties vide Annexure-3. Petitioner, who is an old man having no criminal antecedent, is in custody since 21.02.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, 1st, Madhepura in connection with Uda-Kishunganj P.S. Case No. 63 of 2019.
