ANJANA MISHRA ORAL ORDER 08-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 10.08.2016 in connection with Dawath P.S. Case No. 63 of 2014 registered for the offences punishable under Sections 409 and 120B/34 of the Indian Penal Code.

Case diary in the present case was called for, which has since been received.

Learned counsel for the petitioner submits that petitioner is Panchayat Secretary and had completed virtually all the work but certain parts remained to be completed, for which he alone cannot be held responsible. He further submits that the main accused is still evading arrest whereas the petitioner was taken

Patna High Court Cr.Misc. No.40005 of 2016 (3) dt.08-11-2016 2/2 into custody.

In view of nature of allegation made against the petitioner and that substantial portion of the work had been completed as is evident from the case diary, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajesh Pandey, Judicial Magistrate 1st Class -cum- A.C.J.M-IV, Rohtas at Bikramganj in connection with Dawath P.S. Case No. 63 of 2014.
