This application is for grant of regular bail in connection with Dhibra P.S.Case No.7 of 2014 , registered for the offences punishable under Sections 147, 148, 149, 121(A) and 120(B) of the Indian Penal Code and Section 3 & 4 of Explosive Substance Act, 17 CLA Act.
The petitioner is not named in the F.I.R. and on disclosure of the other co-accused persons his name transpired in this case.
Submission of the learned counsel for the petitioner is that on whose confession, the name of the petitioner has transpired, has already been granted bail by this Court, vide order dated 18.12.2014 passed in Cr. Misc. No.28513 of 2014. It has
Patna High Court Cr.Misc. No.33264 of 2017 (3) dt.08-08-2017 2/2 also been submitted that though the petitioner has criminal antecedent but in all those cases, he has been falsely implicated. Heard learned A.P.P. also.
Having heard both sides and from perusal of the record, it appears that apart from the confession of the co-accused he is accused in 15 other cases of similar type. In such view of the matter, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within reasonable time preferably within nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail before the court concerned. With the aforesaid observation, this application is dismissed.
