The petitioner seeks bail in connection with Sessions Trial No. 248 of 2015/249 of 2015 arising out of Agiaon (G) P.S. Case No. 106 of 2014 registered under Sections 341, 323, 395 and 506 of the Indian Penal Code.
The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 2.9.2015 passed in Cr. Misc. 41073 of 2015.
It is contended that though the petitioner is in custody since 10.9.2014, no witness has been examined on behalf of the prosecution till date.
Regard being had to the fact that despite lapse of two

No.44075 of 2016 (2) dt.05-10-2016 2/2 years, prosecution has failed to produce any witness during trial, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Bhojpur at Ara in connection with Sessions Trial No. 248 of 2015/249 of 2015 arising out of Agiaon (G) P.S. Case No. 106 of 2014.
