The petitioner apprehends his arrest in Vishnupadh P.S. Case No.49 of 2020 registered under Sections 379 and 411 of the Indian Penal Code and under Section 21 of Mines and Minerals (Development and Regulation) Act and Rule 56 (1) of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) Rules, 2019.
The police intercepted a tractor loaded with sand and seized the tractor.
Learned counsel for the petitioner submits that the petitioner handed over the tractor to his driver, who went to load the sand on hire. The petitioner had no knowledge about loading of the sand on his tractor. The tractor is still lying in the police

Learned A.P.P. opposed the prayer for anticipatory bail.
Having considered the facts and the nature of allegation made against the petitioner and the fact that the petitioner is the owner of the tractor, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Vishnupadh P.S. Case No.49 of 2020, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
