The petitioner seeks bail in a case registered under Sections 413, 414/34 of the Indian Penal Code. Allegation is that stolen motorcycle was recovered from the possession of the co-accused Dhanu Rajak, who disclosed that the motorcycle in question was handed over to him by co-accused Himansu Kumar and Lav Kush Kumar (petitioner).
It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.12.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in the present case on the basis of
Patna High Court CR. MISC. No.39243 of 2019(2) dt.27-06-2019 2/2 disclosure made by co-accused. No stolen property is alleged to have been recovered from the conscious possession of the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Dinara P.S. case No.452 of 2018.
