JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 17-08-2017 Heard learned counsel for the petitioner as well as learned APP. During course of patrolling, informant had seen one Thela being carried by one person having occupied by two others who seeing the police, escaped. On search, the items so detailed under seizure list were seized therefrom. Furthermore, it has also been disclosed that from the local inhabitants, he came to know regarding Shyamdeo Tatma to be the owner of Thela while Suliya Bhant and Nunua Bhant (petitioners) to be the occupant thereof.

Though petitioners have got criminal antecedents but are under custody since 07.04.2017 and that being so, petitioners, Md. Rahis @ Nunua Bhant and Samshuddin @ Suliya Bhant are directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM, Birpur (Supaul) in connection with Birpur PS Case No. 75/2017.
