ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 27.07.2016 in connection with Sarayranjan P.S. Case No.172 of 2016 registered for the offence under Section 392/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that neither the petitioner is named in the F.I.R. nor any recovery was made from his possession. It is further submitted that the name of the petitioner has come on the basis of the confessional statement made before the police by one Deepak Kumar from whose possession motorcycle was recovered. Considering the aforementioned facts and

No.46670 of 2016 (3) dt.24-11-2016 2/2 circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of Sri Sankash Chandra, learned Judicial Magistrate 1st Class, Samastipur, in connection with Sarayranjan P.S. Case No.172 of 2016.
