The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code.
As per prosecution case, the allegation against four headmasters including the petitioner who have not completed the construction of Government building even after withdrawal of the fund.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got the certificate of no dues by the competent authority on 10.08.2021 by which, it has been said that work regarding the building construction of the
Patna High Court CR. MISC. No.51847 of 2021(2) dt.04-07-2022 2/2 school has been completed and all payments have been made and there is no any advance dues against him. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ist Additional Sessions Judge, Saran (Bihar) in connection with Jalalpur P.S. Case No. 112 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
