JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Jehanabad P.S. Case No. 147 of 2015 for the offences instituted under Sections 379, 420 of the IPC and 4/10 of the Bihar Examination Conduct Act.

The prosecution story, in brief, is that the informant being the Special Performance Officer, Central (Selection Board) Constable Enrolment, Bihar, Patna, submitted typed report to the S.P., Jehanabad to the effect that in the Constable Enrolment vide Notification No. 01/2014 dated 19.10.2014, during the written examination, the candidate Ranjeet Kumar having Roll No. 1013020435 at S.N. Sinha College and Lakshaman Kumar having

Patna High Court Cr.Misc. No.39786 of 2015 (4) dt.01-10-2015 2/3 Roll No. 1013030401 at S.S. College, Jehanabad Centre committed unfair means and it was detected that they taken away carbon copy of answer book and question paper from the examination centre.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the petitioner has been made accused due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs. 5,000/- in the court below which shall be subject to final disposal of the case On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 5,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Jehanabad P.S. Case No. 147/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad, subject to the conditions as laid down under Section
