JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 25-11-2016 Heard the counsel for the petitioner and Mr. Shastriji, APP for the State.

The petitioner is languishing in custody since 15.07.2016 in connection with Purnahiya P.S. Case No. 49 of 2016 registered under diverse penal provisions of the Arms Act. The A.S.I. lodged the case that he arrested one Mukesh Pathak in another case. Mukesh Pathak made a confessional statement about lying of illegal weapons in the house of Sanjay Jha, Vijay Kumar and the petitioner. The police are said to have conducted raids in the house(s) of the accused persons. It is submitted that no weapon/firearm was recovered from the house of the petitioner. Such recovery was made from the

Patna High Court Cr.Misc. No.48017 of 2016 (2) dt.25-11-2016 2/2 house of Sanjay Jha. The petitioner is in custody since 15.07.2016 having no criminal antecedents.

Considering the facts and circumstances of the case, above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Sheohar in Purnahiya P.S. Case No. 49 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person each date fixed at the trial. In case he dodges his appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
