Petitioner seeks bail in a case registered for the offences punishable under Sections 272,273,414,120(B)/34 I.P.C. and Sections 30(a)/41(1) of the Bihar Prohibition and Excise Act, 2018.

Submission is that the petitioner was not there at the time of recovery of liquor and the persons, who were apprehended from the spot, were already allowed bail by other Coordinate Benches of this Court. Petitioner has got no criminal antecedent under Bihar Prohibition and Excise Act. Learned counsel for the petitioner has filed supplementary affidavit.

Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.38363 of 2020(2) dt.12-02-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Minapur Police Station Case No.212 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
