The petitioner seeks regular bail in Sessions Trial No.28 of 2017 arising out of Dehri Indrapuri P.S. Case No.480 of 2014 registered for the offence under Sections 363 and 364 of the Indian Penal Code.

Allegation as per the F.I.R. against the petitioner is of kidnapping and rape upon the daughter of the informant. Submission of the learned counsel for the petitioner is that victim girl is major and she has married with the petitioner with her sweet will which is evident from Annexure-2 and petitioner is in custody since 21.04.2015.

Heard learned A.P.P. also.

No.35171 of 2017 (2) dt.04-08-2017 2/2 From perusal of the record it appears that the trial has commenced and in such view of the matter at this stage, I am not inclined to grant bail to the petitioner at this stage. However, petitioner may renew his prayer for bail before the trial court after examination of the informant and the trial court considering the evidence of the daughter of the informant will pass an appropriate order.
