Petitioner is accused in connection with Rahui (Bhaganbigha) P.S. Case No. 215 of 2016 registered under Sections 25(1-b), a, 26, 35 of the Arms Act and section 47(a) of the Bihar New Excise Act.
The accusation is of recovery of 83 bottles of foreign liquor, each containing 180 ml. and also two country made pistol from the house of the petitioner.
Submission of learned counsel for the petitioner is that petitioner is aged about 65 years and no incriminating articles have been recovered from his conscious possession. It is also submitted that petitioner has no criminal antecedent and is in
Patna High Court Cr.Misc. No.49868 of 2016 (3) dt.10-02-2017 2/2 custody since 09.08.2016..
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Bihar Sharif in connection with Rahui (Bhagabigha) P.S. Case No. 215 of 2016.
