The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414, 467, 468, 471 and 420/34 of the Indian Penal Code. The prosecution case is that one Bolbam Sharma was apprehended in Ghanshyampur P.S. Case No. 04 of 2015 where he stated that he along with petitioner and coaccused Mukund Kumar Jha stole Pulsar motorcycle and with the help of Yasir Arafat and Nausad kept the said motorcycle in the garage of Mr. Khursid for tampering identification of the alleged Pulsar motorcycle.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.41807 of 2015 (2) dt.09-10-2015 2/2 petitioner that except confession of the co-accused nothing surfaced against the petitioner. It is further submitted that other accused, who were apprehended on confession of Bolbam Sharma, have not named this petitioner. The petitioner is accused in one other case of theft in which he is on bail. The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Ghanshyampur P.S. Case No. 22 of 2015 pending in the court of learned Judicial Magistrate, Ist Class, Biraul, District - Darbhanga. With the aforesaid observation, this application is disposed of.
