The petitioner seeks bail in Mahila P.S. Case No. 8/2018, instituted for the offences under Sections 376 and 420 of the Indian Penal Code read with Section 4 of POCSO Act. It is alleged in the written report that the petitioner established physical relationship with the informant since last three years on the pretext to marry her and the informant became pregnant, but the petitioner refused to marry with informant. Learned counsel for the petitioner has submitted that compromise has taken place between the parties. Compromise petition has been filed before the court below, which is annexed as Annexure-2.
The petitioner is in custody since 21.03.2018.
Patna High Court Cr.Misc. No.42348 of 2018 (3) dt.25-09-2018 2/2 Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge (POCSO), Aurangabad in connection with Mahila P.S. Case No. 8/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
