The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 147, 341, 323, 324, 354B, 308, 379, 385, 504, 506, 34 of the Indian Penal Code.

As per prosecution case, the allegation against the accused persons including the petitioner is that they assaulted the informant and his family members due to they sustained injuries. It is further alleged that co-accused also snatched away mangulsutra of the informant's wife worth Rs. 30,000/- Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. There is case and counter case between the parties and both parties have sustained injuries in separate occurrence. It is further submitted that injury sustained by the injured is simple in nature. Moreover, he is languishing in judicial custody since 05.10.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Turkauliya P.S. Case No. 491 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-19, East Champaran, Motihari.
