The petitioners seek bail in a case registered for offences punishable under Sections 30 (A) and 38(A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 22.5 litres of foreign liquor were recovered from the possession of the petitioners. Petitioners claim that they are having clean antecedent and are in custody since 04.07.2017. Having regard to the facts and the circumstances of the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.37679 of 2017(4) dt.25-08-2017 2/2 Thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Sessions judge, VII-cum-Special Judge, Aurangabad in connection with Amba P.S. Case No. 87 of 2017 with a further condition that one of the bailors must be belonging to the State of Bihar.

Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
