2. The petitioner apprehends arrest in connection with Kudhani PS Case No.111 of 2024 dated 10.04.2024, instituted under Sections 272, 273/34 of the Indian Penal Code and 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. Allegation is of recovery of 45.39 litres of Indian made foreign liquor from the Champkhari's bridge situated at village- Chandrahati.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is further submitted that the petitioner has been made accused only on the basis of disclosure made by the

Patna High Court CR. MISC. No.43731 of 2024(3) dt.02-08-2024 2/2 apprehended accused, namely, Rahul Kumar, who disclosed the name of five accused persons including the petitioner. Learned counsel further submitted that similarly situated co-accused Rakesh Kumar has been granted bail by this Court by order dated 24.07.2024 passed in Cr. Misc. No.44760 of 2024. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. Learned APP has opposed the prayer for bail.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No. II, Muzaffarpur, in Kudhani PS Case No.111 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

7. The application stands allowed.
