The petitioner apprehends his arrest in Saharsa Sadar P.S. Case No. 141/2010, registered for the offences punishable under Section 420, 467, 468, 471 and 34 of the Indian Penal Code and under Section 63, 65 of Copyrights Act and 103, 104 of Trade Mark Act.
The informant alleged that he got information that some duplicate machines of Usha sewing machine was kept in the godown of Maa Annapurna Transport Agency. On such raid was conducted.
It is submitted that the petitioner is the Branch Manager of Maa Annapurna Transport Agency. He is not at all concerned with the consignment. Petitioner is neither a consignee nor sent the
Patna High Court Cr.Misc. No.42230 of 2015 (3) dt.02-12-2015 2/2 machines. He is only responsible for transporting the machines to the consignee. The co-accused Md. Naushad Alam has already been granted anticipatory bail.
Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 141/2010, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
