The petitioners seek bail in Dawath P.S. Case No. 65 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that 2232.36 litres of foreign liquor has been recovered from a truck, four wheeler and the open space. It is further alleged that 172.8 litres of foreign liquor has been recovered from four wheeler bearing Registration No. WB-02K-4666. Petitioners were driver and Khalasi of the aforesaid vehicle.

Counsel for the petitioners submits that co-accused

Patna High Court CR. MISC. No.44397 of 2019(3) dt.26-08-2019 2/2 Rupendra Pal has already been granted bail by this Court vide order dated 19.7.2019 passed in Cr. Misc. 44278 of 2019. Petitioners are in custody since 9.4.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd, cum Special Judge, Excise, Rohtas at Sasaram, in connection with Dawath P.S. Case No. 65 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners. (Sanjay Priya, J) S.Ali/- U T
