NILU AGRAWAL ORAL ORDER 22-11-2016 Heard the learned counsel for the petitioner and the learned APP for the State.
Petitioner is languishing in custody since 26.08.2016 in connection with Patahi P.S.Case No.116 of 2016 registered for offences punishable under Section 414 of the Indian Penal Code. The prosecution case as lodged by the police is that on 26.08.2016 at 13.15 hours after receiving confidential information regarding keeping the stolen motorcycle in the house of accused-petitioner, raid was conducted and in presence of independent witnesses, a motorcycle without registration number was recovered of which petitioner accused did not give satisfactory reply. A seizure list was accordingly prepared. It has been submitted by learned counsel for the petitioner that he has a clean criminal antecedent and that he has
Patna High Court Cr.Misc. No.50060 of 2016 (2) dt.22-11-2016 2/2 falsely been implicated in the aforesaid case. He submits that the stolen motorcycle has been implanted in his house with ulterior motive and he does not have any concern with the said motorcycle.
However, learned APP for the State submits that the petitioner is named in the FIR, hence opposes the prayer for bail. Be that as it may, since the petitioner undertakes not to abscond or tamper with the evidence and cooperate with the police/Court as and when required, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, East Champaran in connection with Patahi P.S.Case No.116 of 2016.
