2. The petitioner is apprehending his arrest in a case in connection with Sasaram (T) P.S. Case No. 724 of 2024 dated 29.08.2024 registered for the offences punishable u/ss 319(2), 318(4), 338, 336(3), 336(4) of the B.N.S.

3. As per the prosecution case, on 28.08.2024, one black colour Fortuner vehicle bearing Reg No. BR01FX0001 was fined by the traffic police and later on it came to the knowledge that the said number was being misused which was registered in the name of Additional Chief Secretary Planning and Development Department, accordingly the FIR was registered against the unknown said vehicle and its owner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of the co-accused, Deepak Kumar, who has already been granted regular bail by this Court vide order dated 15.01.2025 passed in Cr. Misc. No. 80116 of 2024. Nothing has been recovered from the conscious possession of the petitioner. The co-accused, Deepak Kumar is the owner and the co-accused, Pawan Kumar is the driver of the said vehicle. The petitioner has no concern with the alleged recovery. The petitioner has clean antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Rohtas in connection with Sasaram (T) P.S. Case No. 724 of 2024, subject to conditions as laid down under section 482(2) of

7. The application stands allowed.
