The petitioner seeks regular bail in connection with Lakhisarai P.S. Case No.205 of 2017, registered for offence punishable under Sections 272, 273 of the Indian Penal Code and 30(a), 32(c), 38(a) of Bihar Prohibition of Excise Act,2016. Allegation as per the F.I.R. against the petitioner is of recovery of 190 bottles of foreign liquor from abandoned house of the petitioner.

Submission of the learned counsel for the petitioner is that the house was abandoned and nothing has been recovered from his possession. He is in custody for three weeks having no criminal antecedent.

No.35216 of 2017 (2) dt.04-08-2017 2/2 Having heard both sides and in view of the facts and circumstances and nothing has been recovered from his possession, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise), Lakhisarai, in Lakhisarai P.S. Case No.205 of 2017, subject to the conditions that (i) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) The petitioner will not induce any witness or tamper with the evidence. (iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reason, his bail bond shall be cancelled.
