Petitioner seeks regular bail in connection with Piro (Hassam Bazar) PS Case No. 139 / 2017 registered under Sections 307 , 448 , 323 , 341 , 324 , 34 of the IPC and later on Section 302 , 120 (B) of the IPC added.

As per the First Information Report lodged by the victim herself that while she was cooking food in her kitchen the accused persons named in the FIR arrived there and poured kerosene oil upon her and set her ablaze. It has further been alleged that about two days before the date of occurrence the petitioner had threatened the deceased with dire consequences and said that she would not be able to see the Sun of the next morning.

Learned senior counsel for the petitioner submits that from perusal of the First Information Report it would be evident that there is specific allegation against the co-accused persons that they set the informant ablaze and there is only allegation of threatening against the petitioner. No.52815 of 2021(2) dt.06-05-2022 2/2 accused / Bhikhari Singh who was involved in the process of setting the informant on fire has been granted bail by a Coordinate Bench of this Court in Cr. Misc. No. 66237 of 2019. The petitioner is in custody since 8-6-2021 having no criminal antecedent.

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that there is no specific allegation against the petitioner that he set the informant on fire, petitioner is in custody since 08-06-2021, charge sheet has already been submitted and similarly situated accused person has been granted bail by this Court, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Piro ( Hassam Bazar ) P.S Case No. 139 of 2017.
