The petitioner apprehends his arrest in connection with Mohania P.S. Case No. 96 of 2021 registered under Sections 414 of the Indian Penal Code and 30(a) of Bihar Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to village politics and party bandy. Further submission is that the alleged motorcycle from which the alleged recovery has been made, does not belong to the petitioner and petitioner has no knowledge about the alleged motorcycle. Petitioner has no criminal history. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

No.54772 of 2021(2) dt.08-04-2022 2/2 event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise, Kaimur at Bhabua in connection with Mohania P.S. Case No. 96 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
