JUSTICE RAMESH KUMAR DATTA ORAL ORDER 04-09-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The grievance of the petitioner is that he has not been granted the promotion in the B.Sc. trained pay scale in Grade-III, Pay Band-2 with Grade Pay with effect from 19.08.2013, i.e., the date of promotion of his immediate juniors, despite the petitioner having requisite qualification for the same.

It is submitted by learned counsel for the petitioner that by office order dated 9.7.2013, the direction was given to produce the necessary documents with regard to the eligibility for being granted B.Sc. trained scale and grade pay, pursuant to which the petitioner by letter dated 19.7.2013 submitted all his documents before the District Programme Officer (Establishment), Vaishali along with his representation of the same date but no action has

In the aforesaid view of the matter, the writ application is disposed of with a direction to the competent authority to consider and dispose of the representation dated 19.7.2015 of the petitioner within a period of two months from the filing of a fresh copy of the said representation including Annexures along with a copy of this order.
