This is an application for bail in connection with Sheohar P.S.Case No. 78 of 2017 registered for the offences punishable under Sections 467, 468, 471, 419, 420, 406, 409 and 120B of the Indian Penal Code.

Allegation as per FIR is that on the complaint the I.O. was directed to raid the Bank and when he raided the Bank he found two persons filling withdrawal form and on query they disclosed that they are nephew and brother of Mukhiya Shatrudhan Das and the petitioner is Bank Manager. It has been submitted on behalf of the petitioner that petitioner was not present and the Bank was closed at that time and there is no recovery from the possession of the petitioner or from the Bank and petitioner is in custody for more than two months.

Having heard both sides and considering the aforesaid facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheohar, in connection with Sheohar P.S.Case No. 78 of 2017, subject to the conditions that :- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the investigation with police and make himself available as and when required, failing which his bail bond shall be cancelled. (Vinod Kumar Sinha, J) spal/- U
