====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 31-07-2023 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 363, 366(A)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioners are said to have kidnapped minor daughter of the informant aged about 17 years with an intention to marry her.

4. It is submitted on behalf of the petitioners that petitioners are innocent and have falsely been implicated in this case. The victim girl in her statement under Section 164 Cr.P.C.

Patna High Court CR. MISC. No.42277 of 2023(2) dt.31-07-2023 2/2 has stated that she has gone with the petitioner out of her own sweet will and has solemnized marriage with him.

5. Considering the statement of victim under Section 164 of the Cr.P.C., prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two surities of the like amount each to the satisfaction of learned A.C.J.M. IInd Saran at Chapra in connection with Panapur P.S. Case No. 196 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
