Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 379, 307, 504,
2/4 506 of the Indian Penal Code.
It is submitted by learned counsel for the petitioner that petitioner No. 2 namely Chintu Kumar @ Chintu Kumar Singh has been arrested. Hence, he seeks permission to withdraw the petition.
Permission is accorded.
Accordingly, the petition with regard to petitioner No. 2 is dismissed as withdrawn.
The prosecution case as per F.I.R is that six unknown miscreants looted the articles of the informant and assaulted with knife. The accused persons took the informant at the door of the father of the petitioners and tied his hands and legs. The informant somehow managed to escape from the scene and went to the police station. The police went at the door of the petitioners and searched the house and recovered all the articles of the informant. One Manoj Paswan was apprehended from the place of seizure and he disclosed the name of the petitioners as persons who fled away
3/4 after seeing the police personnel.
It is submitted by learned counsel for the petitioners that the name of the petitioners surfaced on the confessional statement of co-accused Manoj Paswan. In fact, for a petty dispute between the son of the petitioners and the informant during a cricket match, the present false accusation has been levelled against the petitioners. A supplementary affidavit has been brought on record to the effect that the injuries of the informant have been found to be simple caused by hard and blunt substance. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforestated facts, let the petitioners, above named, except petitioner No. 2, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional
