The petitioner seeks bail in Madanpur P.S. Case No. 137 of 2021, registered for the offence punishable punishable under Section 30(a)(d), 33/34 of the Bihar Prohibition and Excise Act, 2018.
700 litres of spirit and 78 litres of country made liquor has been recovered from the house of co-accused Kamlesh Yadav.
It is submitted that no recovery has been made from conscious possession of this petitioner. Recovery has been made from the house of co-accused. Petitioner is in custody since 12.06.2021 having no criminal antecedent, as stated in para 3 of
Patna High Court CR. MISC. No.51088 of 2021(2) dt.29-11-2021 2/2 the petition. Investigation is complete.
Considering the period of custody coupled with the fact that petitioner bears clean antecedent, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise, Aurangabad in connection with Madanpur P.S.
