Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Murder of the son of the informant and one Rekha Devi was committed in the house of Rekha Devi by causing firearm injury. FIR says that Rekha Devi was a lady of easy virtue and had relation with the criminal associates. During investigation of the case, son of Rekha Devi stated before the police that he had seen the occurrence but he does not claim to have identified the assailant.
Submission of learned counsel for the petitioner is that during whole of the investigation, no direct evidence
Patna High Court CR. MISC. No.38789 of 2019(3) dt.25-09-2019 2/2 surfaced against the petitioner. Petitioner has got no criminal antecedent and he is in custody since 23.10.2018. Petitioner is ready to cooperate with the trial of the case. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 214 of 2019 arising out of Mohiuddin Nagar Police Station Case No. 156 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
