The petitioner seeks bail in Lauriya P.S. Case No. 165 of 2007 registered under Section 363 and 366 of the Indian Penal Code.

As per the prosecution case, petitioner is said to have kidnapped the wife of the informant while she had stepped out of her house for defecation.

It is submitted by learned counsel for the petitioner that the petitioner has not kidnapped the victim. The victim in her statement recorded under Section 164 Cr.P.C. has herself denied her kidnapping by the petitioner and has stated that she was in love with the petitioner and has suo motu went to this house and her in laws has falsely implicated the petitioner in this case. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrates 1st, Bettiah, West Champaran in connection with Lauriya P.S.
