The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 25 liters country made liquor were recovered from the 'Basa' of the petitioner. Petitioner claims his antecedent to be clean and he is in custody since 25.05.2017.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten

Patna High Court Cr.Misc. No.33782 of 2017() dt.20-07-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge (Excise Act), Purnea in connection with Special Excise Case No.1181 of 2017 arising out of Rupauli (Mohanpur) P.S. Case No.122 of 2017.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
