JUSTICE SUDHIR SINGH ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 302/34 of the Indian Penal Code.

It is alleged by the informant that on 06.12.2016 when he along with his son and grand son was going to village from Sasaram about 2 P.M., six persons riding two motorcycles boarded them .Thereafter Pintu Sharma caught his waist and Bhola caught his hands. Then the petitioner instigated and Vijay opened fire and they fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 01.07.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses

Patna High Court Cr.Misc. No.44432 of 2016 (2) dt.19-10-2016 2/2 alleged against the petitioner. The petitioner is an order giver. No injury has been attributed against him. The main allegation is against co-accused- Vijay Singh.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas in connection with Sasaram (Agrer) P.S.Case No. 169 of 2016.
