Petitioner apprehends arrest in connection with Maniyari P.S. Case No. 40 of 2020 registered for the offence punishable under sections 272, 273, 290/34 of the Indian Penal Code and sections 30(a), 34, 36, 38, 41, 56(D), 56(E) of the Bihar Excise Act, 2016.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to previous enmity. Nothing has been recovered from his conscious possession. He had given his vehicle to Ranjit Kumar for taking his mother to the hospital. Petitioner has no criminal antecedent.
Patna High Court CR. MISC. No.38279 of 2020(3) dt.26-10-2021 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioner is named accused in the first information report and there is recovery from his vehicle. Petitioner, therefore, does not deserve to be granted the privilege of bail.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of anticipatory bail to the petitioner. The same is, therefore, rejected.
