The petitioner seeks bail in anticipation of his arrest in connection with Naubatpur P.S. Case No.148 of 2021 instituted for the offences under Sections 399, 402 of the Indian Penal Code & Sections 25(1-B)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is said to have assembled for committing dacoity with other persons, however, learned counsel submits that the petitioner is a student and he has no criminal antecedent and he has been falsely impleaded in the case of commission of dacoity. I have considered the submission.

Taking into consideration the facts and circumstances of the case, where allegedly 10-15 persons gathered and 7 of

In view thereof, I am inclined to grant anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
