JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-09-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month. Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Raniganj P.S. Case No. 141 of 2021 registered for offence punishable under sections 143, 147, 148, 149, 427, 341, 504, 354(B), 379, 307, 323, 324 and 325 of the Indian Penal Code. As per allegation, the accused persons came to the house of the informant and they dismantled hut and khutta of the informant. At the order of petitioner no. 1, petitioner no. 2 assaulted him with farsa on his head and petitioner no. 3 also

The learned counsel for the petitioners has submitted that the petitioners are innocent. There is land dispute between the parties. There is case and counter case. The petitioners are the persons of clean antecedents. The injuries suffered by the informant are simple in nature. The petitioners are on bail in Raniganj P.S. Case No. 348 of 2017, as mentioned in paragraph no. 3 of this bail petition.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Araria in connection with Raniganj P.S. Case No. 141 of 2021, subject to condition as laid down under section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
