Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376/511 of the Indian Penal Code.

The prosecution case is that the petitioner took the informant to the Maize field and made an attempt to ravish her.

It is submitted by the learned counsel for the petitioner that though in 164 Cr.P.C. statement the victim stated that she was actually been ravished by the petitioner. The Medical report found the victim aged about 14-15 years, but no external injury or sign of rape has been found, though the informant was found used to sexual intercourse since long. Statement has been made in para-3 of the petition that

Patna High Court Cr.Misc. No.40001 of 2015 (2) dt.07-10-2015 petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioner, if the petitioner surrender before the learned court below within a period of six weeks from today in connection with Amdabad P.S. Case No. 53 of 2015, pending in the court of learned Judicial Magistrate, Ist Class, Katihar.

With this observation this application is disposed of.
