The trial court has reported that only charge could be framed but no witness has been produced by the prosecution up till now.
Submission on behalf of the petitioner is that petitioner is in jail custody for near about two years and, therefore, he deserves to be released on bail.
Petitioner happens to be husband of the deceased Priyanka Kumari and he has been made accused in a case in which charge sheet has been submitted under section 304B of the Indian Penal Code. Therefore, again I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Hajipur Town P.S.Case No. 51 of 2015, pending in the court of
Patna High Court Cr.Misc. No.46330 of 2016 (3) dt.11-01-2017 2/2 Chief Judicial Magistrate, Vaishali at Hajipur stands rejected. However, the petitioner may renew his prayer for bail after four months if his trail is not concluded within the above stated period.
