====================================================== CORAM: HONOURABLE MR. JUSTICE V.N. SINHA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the State.

Petitioner is apprehending his arrest in connection with a case registered for the offence under Section 414 of the Penal Code. He is the driver of the pick-up van registered in the name of his son, wherefrom 59 bags of rice has been seized. It is submitted that the bags seized from the pick-up van is not a stolen property, reference in this connection is made to Inquiry Report contained in Memo No. 294 dated 08.05.2015 submitted by Sub-Divisional Officer, Madhepura to the Superintendent of Police, Madhepura.

Let petitioner, named above, surrender

Patna High Court Cr.Misc. No.40261 of 2015 (2) dt.07-10-2015 in the court below within four weeks from the date of receipt/production of a copy of this order in the court below, thereafter be released on bail on furnishing bond of Rs. 5,000/- (five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S.

Case No. 260/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as it said that besides the present case he is not accused in any other case, which fact be verified before releasing the petitioner on bail. Until verification is made, no coercive steps be taken against the petitioner.
