JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 23-08-2017 The petitioner has filed this application for quashing of the order dated 07.04.2014 passed by the learned Adhoc Additional Sessions Judge-IV, Bettiah in Sessions Trial No. 09 of 2014, whereby the petition filed by the petitioner under Section 227 of the Cr.P.C. has been rejected. After hearing the parties and on perusal of the record, this Court is not inclined to interfere with the order passed by the court below dated 07.04.2014. However, liberty shall be available to the petitioner to approach the court below at appropriate stage to establish that there is no evidence in this case and as such the proceeding in this case may be closed. With the aforesaid observation, this application stands disposed of.
