Admittedly, neither petitioner was caught on the spot nor anything was recovered from his conscious possession. Petitioner does not have any criminal antecedent and has been made accused in this case on the basis of confessional statement of co-accused, who was caught on the spot.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Patna in connection with Session trial no. 543 of 2016 arising out of Kadamkuan P.S.Case No. 174 of 2016.
